On Thursday, 10 March 2025, the European Parliament and the Council provisionally agreed on the draft directive on soil monitoring.
The Directive provides that EU countries will monitor and assess the condition of all soils on their territory on the basis of common criteria characterising the physical, chemical or biological aspect of soil conditions for each soil type, and a common methodology for sampling points.
The provisionally adopted Directive does not impose any new obligations on landowners and managers, but requires Member States to help them improve the soil‘s ability to continue to play its important role in the ecosystem.
It also requires Member States to draw up a public list of potentially contaminated sites and to address any unacceptable risks to human health and the environment.
Finally, an indicative list of emerging substances, including PFA‘S likely to present a significant risk to soil health, human health or the environment, and for which data are required, will be drawn up 18 months after the entry into force of the law.
The Council must now formally adopt the agreement, which can then be approved by Parliament at second reading.
The Directive will enter into force 20 days after its publication in the EU’s Official Journal, after which Member States will have three years to comply.
