France – Entry into force on 1 January 2026 of Decree No. 2025-1376 of 28 December 2025 on the prevention of risks arising from exposure to per- and polyfluoroalkyl substances

A decree of 28 December 2025 strengthens the legal framework applicable to per- and polyfluoroalkyl substances (PFAS). It specifies the conditions under which the placing on the market of certain products containing these persistent substances is prohibited.

The text defines the concepts of PFAS and of placing on the market, explicitly including imports. It also sets out the categories of products that may benefit from exemptions from the prohibition provided for by law.

The decree further establishes precise threshold values for residual PFAS content in order to harmonise controls and provide legal certainty for economic operators. These values are intended to evolve in line with European standards, in particular the REACH and POP Regulations.

The decree entered into force on 1 January 2026. However, a transitional period of twelve months is provided for the sale or export of products manufactured before that date, after which any placing on the market will be prohibited.
